End User License Agreement

1. Grant of License

Subject to your strict and continuous compliance with the terms and conditions of this Agreement, Robez Enterprises LLC grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to download, install, and access MathSwipe™ solely for your personal, non-commercial entertainment purposes on a compatible device that you legally own or control.

You expressly acknowledge and agree that MathSwipe™ is licensed, not sold, to you under this Agreement. This license does not convey, transfer, or assign any ownership interest, commercial rights, title, or equity in MathSwipe™, Robez Enterprises LLC, or any of the underlying software, source code, business operations, or intellectual property associated with the application. All rights not expressly granted to you herein are strictly and entirely reserved by Robez Enterprises LLC.

2. Restrictions on Use

Your license to experience MathSwipe™ is strictly limited to playing the game as it is officially provided by Robez Enterprises LLC. You expressly agree that you will not, nor will you authorize or encourage any third party to:

• Reverse Engineer or Decompile: Disassemble, deconstruct, or attempt to derive the source code, underlying math-generation algorithms, or swiping logic that powers the MathSwipe™ application.

• Hack or Exploit the Mechanics: Manipulate the gameplay loop, employ unauthorized cheats, or utilize automated scripts (bots) to bypass in-game rules, artificially inflate scores, or compromise the integrity of any competitive features or leaderboards.

• Scrape or Rip Assets: Copy, extract, scrape, or reproduce any of the game’s colorful graphics, user interface designs, visual tiles, animations, or audio elements for any use outside of the official application.

• Clone, Repackage, or Resell: Modify, distribute, translate, or create derivative works based on MathSwipe™, nor may you repackage the app, its branding, or its core gameplay mechanics to sell, monetize, or present as your own creation.

Any violation of these restrictions constitutes a material breach of this Agreement, resulting in the immediate and permanent revocation of your license to access MathSwipe™, and may subject you to civil and criminal liability.

3. Intellectual Property Rights

You expressly acknowledge and agree that MathSwipe™ is the exclusive, proprietary intellectual property of Robez Enterprises LLC. While you are granted a limited license to play the game, Robez Enterprises LLC retains absolute, undivided ownership of all rights, title, and interest in and to MathSwipe™ worldwide.

This comprehensive ownership encompasses, but is strictly not limited to:

• The Code and Architecture: The underlying source code, math-generation algorithms, swiping mechanics, database structures, and all technical frameworks that power the application.

• The Branding and Identity: The "MathSwipe™" name, logos, typography, trade dress, marketing materials, and all associated commercial goodwill.

• The Creative Assets: All visual and auditory components, including the colorful graphics, user interface (UI) design, visual tiles, animations, sound effects, and any written content within the game.

Your permitted use of MathSwipe™ does not grant you any ownership stake, implied rights, or intellectual property interest in the game or Robez Enterprises LLC's broader corporate portfolio. Any unauthorized reproduction, distribution, or public display of these proprietary elements constitutes a direct infringement of Robez Enterprises LLC’s copyright, trademark, and other intellectual property rights under applicable law.

4. Termination and Suspension of Access

Robez Enterprises LLC reserves the absolute, unilateral right to suspend, restrict, or permanently terminate your license and access to MathSwipe™ at any time, without prior notice or liability.

This immediate revocation of access will be enforced if we determine, at our sole discretion, that you have breached any provision of this Agreement or engaged in conduct detrimental to the MathSwipe™ community. Such actionable offenses strictly include, but are not limited to:

• Cheating and Exploits: Utilizing automated swiping scripts, third-party software, or in-game exploits to manipulate the math-generation logic or bypass the intended gameplay mechanics.

• Leaderboard Manipulation: Attempting to hack, spoof, or artificially inflate your scores or standings on the MathSwipe™ leaderboards.

• Rule Violations: Any action that compromises the competitive integrity, fair play, or technical stability of the application.

Upon termination, your limited license to play MathSwipe™ is immediately extinguished. You must cease all use of the application and delete it from your devices. Any in-game progress, high scores, or leaderboard rankings associated with your account will be permanently forfeited, and Robez Enterprises LLC bears no obligation to restore them.

5. Disclaimer of Warranties

ROBEZ ENTERPRISES LLC PROVIDES MATHSWIPE™ STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

To be perfectly clear about what this means for your gameplay experience, Robez Enterprises LLC does not legally promise, warrant, or guarantee that:

• Flawless Execution: The app will be 100% bug-free, that the math-generation algorithms will never experience a glitch, or that your screen swipes will register with zero latency every single time.

• Universal Compatibility: MathSwipe™ will run flawlessly—or at all—on every mobile device, tablet, or operating system. The game is optimized for modern hardware, and we bear no obligation to ensure functionality, visual fidelity, or stability on outdated, modified, or unsupported cell phones.

• Uninterrupted Access: All game progress, high scores, and saved data for MathSwipe™ are stored strictly locally on your personal device. Robez Enterprises LLC does not maintain remote servers, cloud backups, or syncing services for your game data. You expressly acknowledge that if your device is lost, damaged, or replaced, or if the MathSwipe™ application is uninstalled, updated, or corrupted, your local save data may be permanently destroyed. Robez Enterprises LLC bears no responsibility or liability for the loss of this data, and we possess no ability to recover or restore your progress under any circumstances.

By downloading and playing MathSwipe™, you expressly acknowledge and accept that you assume all risks associated with the game's performance and quality.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ROBEZ ENTERPRISES LLC, ITS DIRECTORS, OFFICERS, OR AFFILIATES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF MATHSWIPE™.

To translate this financial shield into specific gameplay terms, Robez Enterprises LLC is legally absolved from any liability regarding:

• Hardware Casualties: Any claims that a MathSwipe™ glitch, bug, or performance issue crashed, overheated, bricked, or otherwise permanently damaged your mobile device, tablet, or operating system.

• Data and Progress Loss: Any emotional or financial distress caused by corrupted save files, erased in-game progress, or the sudden loss of a hard-earned spot on the MathSwipe™ leaderboards.

• Loss of Profits or Revenue: Any bizarre assertions that playing or being unable to play MathSwipe™ somehow cost you business opportunities or personal income.

UNDER NO CIRCUMSTANCES SHALL THE TOTAL CUMULATIVE LIABILITY OF ROBEZ ENTERPRISES LLC FOR ANY DIRECT DAMAGES, HARDWARE FAILURES, OR LEGAL CLAIMS ARISING OUT OF THIS AGREEMENT EXCEED THE ACTUAL AMOUNT YOU PAID DIRECTLY TO ROBEZ ENTERPRISES LLC FOR MATHSWIPE™, OR FIFTY US DOLLARS ($50.00), WHICHEVER IS GREATER. THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ASSERTED, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. Governing Law and Exclusive Jurisdiction

This Agreement, and any disputes, claims, or legal actions arising out of or in connection with your use of MathSwipe™, shall be governed by and construed strictly in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

By downloading, accessing, or playing MathSwipe™, you expressly agree that any legal action, suit, or proceeding against Robez Enterprises LLC must be instituted exclusively in the state or federal courts located within the State of Florida. You hereby unequivocally consent and submit to the personal jurisdiction of such courts for the purpose of litigating any such action, and you permanently waive any jurisdictional, venue, or inconvenient forum objections to such courts.
